1. Use of Our Website

2. Products and Product Information

We make reasonable efforts to ensure that product descriptions, images, dimensions, colours and other information displayed on our website are accurate.

2.1 Colours may appear differently depending on your device or monitor.

2.2 Product images may be illustrative and may not always represent the exact colour or appearance of a product.

2.3 Product specifications may change where manufacturers or suppliers update their products.

2.4 Products are subject to availability.

2.5 We reserve the right to limit quantities, discontinue products or correct errors in product information.

Nothing in this section limits your rights under the Australian Consumer Law where a product does not match its description or otherwise fails to meet a consumer guarantee.

3. Pricing

3.1 All prices displayed on our website are in Australian Dollars (AUD).

3.2 Prices include GST.

3.3 We may change prices at any time before an order is accepted. We take reasonable care to ensure that prices displayed on our website are accurate.

3.4 If we discover a genuine pricing error after you have placed an order, we may contact you before fulfilling the order to discuss the error.

3.5 If an order cannot reasonably be fulfilled at the incorrect price, we may cancel the affected order and provide a full refund of any amount paid.

4. Orders and Payment

4.1 Placing an Order

When you place an order through our website, you are submitting an offer to purchase the products selected at the price displayed at the time of purchase.

We may accept or decline an order for legitimate reasons, including product availability, pricing errors, payment issues or suspected fraud.

An order will generally be considered accepted when we confirm the order and begin processing it for fulfilment.

You will receive an order confirmation by email after placing an order.

4.2 Payment

Payment is required at the time of purchase unless another payment arrangement is expressly offered.

We accept the payment methods displayed at checkout.

Payments are processed securely through Shopify Payments and/or other approved payment providers available at checkout.

We do not generally store complete payment card details on our own systems.

5. Order Cancellation

You may request cancellation of an order by contacting us as soon as possible at: peter@infinityclocks.com.au

5.1 We will make reasonable efforts to accommodate cancellation requests received before an order has been processed or dispatched.

5.2 Once an order has been processed or dispatched, cancellation may no longer be possible and you may instead need to follow our Returns & Refunds Policy.

5.3 Nothing in this section limits any cancellation, refund or other rights you may have under the Australian Consumer Law.

We may cancel an order where, for example:

5.4 The product is unavailable.

5.5 There has been a genuine pricing or product-information error.

5.6 Payment cannot be processed.

5.7 We reasonably suspect fraudulent or unauthorised activity.

If we cancel an order after payment has been received, we will provide an appropriate refund.

6. Shipping and Delivery

6.1 Infinity Clocks currently ships to customers within Australia.

6.2 Delivery timeframes provided on our website or at checkout are estimates unless expressly stated otherwise.

6.3 You are responsible for providing accurate delivery information when placing an order.

6.4 If you provide an incorrect or incomplete delivery address, additional costs or delays may result.

6.5 If a delivery issue occurs, please contact us so that we can assist in resolving the matter with the relevant delivery provider.

Nothing in this section limits your rights under the Australian Consumer Law in relation to delivery or products that are not supplied within a reasonable time where applicable.

7. Returns and Refunds

Please refer to our Returns & Refunds Policy for full details of our change-of-mind returns process.

7.1 Our voluntary change-of-mind policy may include a 30-day return period for eligible products, subject to the conditions specified in our Returns & Refunds Policy.

7.2 Our change-of-mind policy is separate from your rights under the Australian Consumer Law.

7.3 If a product is faulty, defective, unsafe, significantly different from its description or otherwise fails to meet an applicable consumer guarantee, you may have rights to a repair, replacement, refund or other remedy regardless of our voluntary change-of-mind return period.

7.4 We will not use our change-of-mind policy to restrict or exclude your rights under the Australian Consumer Law.

8. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

8.1 These consumer guarantees apply automatically where applicable and are not replaced by any warranty, return policy or other terms offered by Infinity Clocks.

8.2 The Australian Consumer Law may provide additional rights depending on the circumstances of a particular purchase or product issue.

9. Intellectual Property

Unless otherwise stated, the content on our website, including text, graphics, logos, photographs, product descriptions, page layouts and other material, is owned by Infinity Clocks or used under licence.

9.1 You may access and use our website for personal and lawful purposes.

You must not, without our written permission:

10.6 Any termination will not affect rights or obligations that have already arisen.

12.3 Our liability for loss or damage where such liability cannot lawfully be excluded.

12.4 Where permitted by law, our liability in relation to a particular product or service will be limited to the remedies available under the applicable law and, where legally permitted, the amount paid for the relevant product or service.

12.5 Nothing in these Terms is intended to prevent you from seeking compensation for reasonably foreseeable loss or damage where you are legally entitled to do so.

Your privacy is important to us.

13.1 Please refer to our Privacy Policy for information about how we collect, use, disclose and protect personal information.

13.2 Infinity Clocks is committed to complying with the Australian Privacy Principles contained in the Privacy Act 1988 (Cth), to the extent those requirements apply to our business.

14. Gift Cards

Gift cards issued by Infinity Clocks are subject to the following conditions:

14.1 Gift cards are valid for 5 years from the date of issue.

14.2 Gift cards may be used for eligible purchases at infinityclocks.com.au.

14.3 Gift cards cannot be exchanged for cash except where required by law.

14.4 No post-supply fees apply, including activation, account-keeping, inactivity or balance-inquiry fees.

14.5 Gift cards cannot be reloaded or topped up unless expressly stated otherwise.

14.6 The expiry date will be displayed on the gift card or otherwise provided to the purchaser or recipient.

14.7 Gift cards may not be replaced if lost or stolen, except where required by law or where we are able to verify the remaining balance and ownership.

14.8 Any unused balance remains subject to the expiry date of the gift card.

14.9 Nothing in these terms excludes or limits any rights you may have under applicable Australian law.

15. Third-Party Links and Services

15.1 Our website may contain links to third-party websites, applications or services.

15.2 Third-party websites and services operate independently from Infinity Clocks and may have their own terms and privacy policies.

15.3 We are not responsible for the content, availability or privacy practices of third-party websites.

16. Website Availability

16.1 We aim to keep our website available and functioning correctly, but we do not guarantee that the website will always be uninterrupted, error-free or available.

16.2 The website may occasionally be unavailable due to maintenance, technical issues, updates, security measures or circumstances outside our reasonable control.

17. Events Outside Our Reasonable Control

17.1 We are not responsible for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, severe weather, transport disruptions, industrial disputes, government restrictions, internet or telecommunications failures, cyber incidents affecting third-party providers, or other events that could not reasonably have been prevented.

17.2 Where such an event affects an order, we will take reasonable steps to communicate with you and minimise the impact.

17.3 This section does not limit your rights under the Australian Consumer Law.

18. Governing Law

18.1 These Terms are governed by the laws of Queensland, Australia.

18.2 You submit to the non-exclusive jurisdiction of the courts of Queensland and any applicable courts of appeal.

18.3 Nothing in this section prevents you from exercising rights or remedies available under Australian consumer law.

19. Resolving Disputes

21.2 The remaining provisions will continue to apply.

22. Entire Agreement

22.1 These Terms, together with our Privacy Policy, Returns & Refunds Policy and Shipping & Delivery Policy, form the terms governing your use of our website and your purchases from Infinity Clocks, subject to any rights and obligations imposed by applicable law.
